terms of service
Effective October 30, 2026
These Terms of Service (“Terms”) are an agreement between you and We Stay Dialed (“We Stay Dialed,” “we,” “us,” or “our”). They cover your use of our website, your account, and our accountability call service (together, the “Service”). By creating an account, subscribing, or using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the Service.
Short version: a real person calls you at times you choose to check in on a goal you set. We are not therapy, medical care, or an emergency service, and we don’t guarantee results. Your subscription renews automatically until you cancel, which you can do anytime from your account.
1. What the Service is
We Stay Dialed provides short, scheduled accountability check-in calls made by a person on our team. You tell us your goals and when you can be reached. We call within the windows you choose, ask about your progress, and help you name a next step. After calls we may post short written updates to your account.
The website and account exist to set up and support the calls: onboarding, viewing updates from us, logging progress, requesting changes, and managing billing. We may change, add, or remove features of the Service at any time.
2. What the Service is not
We Stay Dialed is not therapy, counseling, coaching for a medical or mental-health condition, medical advice, financial or legal advice, or a crisis or emergency service. Our team members are not acting as licensed healthcare, mental-health, financial, or legal professionals when they call you, even if someone happens to hold such a license. Nothing said on a call or written in your account is a diagnosis, treatment, or professional recommendation.
Talk to a qualified professional before starting any fitness, diet, medical, or financial program. You are responsible for the goals you choose and how you pursue them. If you are in crisis or may harm yourself or someone else, call 911 or your local emergency number, or call or text 988 (Suicide & Crisis Lifeline) in the U.S. Don’t wait for a scheduled call.
3. No guarantee of results
We show up and remember what you said; the work is yours. We do not promise or guarantee that you will reach any goal or get any particular outcome, and your results depend on you.
4. Eligibility and your account
You must be at least 18 years old and able to form a binding contract to use the Service. The Service is intended for people in the United States. You agree to give accurate information, including a phone number you are authorized to use, and to keep it up to date.
You are responsible for keeping your password confidential and for activity under your account. Tell us right away if you think your account has been accessed without permission. One account is for one person; don’t share it.
5. Calls, texts, and emails: your consent
By checking the consent box and giving us your phone number, you agree that We Stay Dialed and people acting for us may call you at that number for scheduled accountability calls and related scheduling. Calls are placed by a person. If you separately opt in, we may send texts about scheduling, and emails about your account and billing. Message and data rates may apply. Consent to calls or texts is not a condition of buying anything other than the call service itself.
You can change your contact preferences in your account, tell your caller during a call, or email us at support@westaydialed.com or use our contact form. To stop texts, reply STOP. If you withdraw consent to calls, we can’t provide the core Service, but we’ll honor your request.
We do not record calls. Our team takes written notes during and after calls to prepare for future calls. Some notes are private to our staff; the updates we publish to your account are the ones you can see.
6. Scheduling and missed calls
We’ll make reasonable efforts to call within your chosen windows, but exact times aren’t guaranteed and calls may occasionally need to move. If you miss a call, we may leave a voicemail and will note it. You can request a new time from your account. Missed calls, whether on your side or ours, don’t extend your billing period or entitle you to a refund unless we say otherwise in writing or the law requires it. If we have to cancel a call, we’ll try to reschedule it.
7. Subscriptions, billing, and automatic renewal
The Service is offered as a paid subscription. The price, billing interval, and any taxes are shown before you pay. Payments are processed by our payment processor, Stripe; we never see or store your full card number. By subscribing, you authorize us (through Stripe) to charge your payment method at the start of each billing period.
Your subscription renews automatically at the end of each billing period at the then-current price until you cancel. We’ll give you advance notice of any price change, and the new price applies starting with your next billing period after the notice. If you don’t agree to a price change, you can cancel before it takes effect.
If a payment fails, we may retry the charge, pause calls, or end your subscription. You are responsible for any amounts owed.
8. Cancellation and refunds
You can cancel anytime from your account (“Manage billing”) or by contacting us. Cancellation takes effect at the end of your current billing period. You keep access, and we keep calling, until then, and you won’t be charged again.
Except where required by law, payments are non-refundable and we don’t provide refunds or credits for partial billing periods or unused calls. We may, at our discretion, offer a refund or credit in a particular case; doing so once doesn’t obligate us to do it again.
9. How you agree to behave
You agree not to:
- Harass, threaten, abuse, or demean our team members on calls or in messages
- Give a phone number you aren’t authorized to use, or impersonate anyone
- Use the Service for anything unlawful, or to plan or carry out harm to yourself or others
- Try to access accounts, data, or systems you aren’t authorized to access, or disrupt the Service
- Scrape, copy, resell, or build a competing product from the Service or its content
Our team may end a call that becomes abusive or unsafe. We may suspend or terminate accounts that break these rules.
10. Your content
You own what you tell us: your goals, progress updates, and messages (“Your Content”). You give us a limited license to store, use, and process Your Content to provide, support, and improve the Service, as described in our Privacy Policy. Don’t share anything you don’t have the right to share, or other people’s sensitive information.
11. Our content and brand
The Service, including our website, software, text, design, logo, and the We Stay Dialed name, belongs to us or our licensors and is protected by law. We give you a personal, non-transferable, revocable right to use the Service for its intended purpose. If you send us feedback or suggestions, we may use them without any obligation to you.
12. Third-party services
We rely on third parties such as our payment processor, hosting provider, phone carriers, and software tools. Their services are governed by their own terms, and we aren’t responsible for their acts or outages.
13. Suspension and termination
You may stop using the Service at any time. We may suspend or end your access if you breach these Terms, fail to pay, put our team at risk, or if we stop offering the Service. If we end the Service for reasons other than your breach, we’ll refund any prepaid amount for the unused part of your current billing period. Sections that by their nature should survive termination (including payment obligations, disclaimers, limits of liability, indemnity, and dispute terms) will survive.
14. Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the Service will be uninterrupted, error-free, or achieve any result.
15. Limitation of liability
To the fullest extent permitted by law, We Stay Dialed and its owners, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill, arising from or related to the Service or these Terms, even if advised of the possibility. Our total liability for all claims related to the Service or these Terms is limited to the greater of the amount you paid us in the three months before the claim arose or fifty U.S. dollars ($50).
Some places don’t allow certain limits on liability, so some of these limits may not apply to you.
16. Indemnity
You agree to defend and hold harmless We Stay Dialed and its team from claims, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of others.
17. Disputes and governing law
If you have a problem, please email us at support@westaydialed.com or use our contact form first. Most issues can be solved quickly that way, and you agree to try for at least 30 days before starting a formal claim.
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-laws rules. Any claim that isn’t resolved informally must be brought in the state or federal courts located in Salt Lake County, Utah, and you and we consent to their jurisdiction, except that either of us may bring an individual claim in small-claims court if it qualifies. To the extent allowed by law, you and we each agree to bring claims only in an individual capacity and not as a plaintiff or class member in any class or representative action.
18. Changes to these Terms
We may update these Terms. If a change is material, we’ll notify you by email or in your account before it takes effect. Continuing to use the Service after the effective date means you accept the updated Terms. If you don’t agree, cancel before the change takes effect.
19. Everything else
These Terms and our Privacy Policy are the entire agreement between you and us about the Service. If any part is found unenforceable, the rest stays in effect. Our not enforcing a provision isn’t a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition, or sale of assets. We aren’t liable for delays caused by events beyond our reasonable control.
